Terms of Service

These Terms are a starting point drafted by KnowledgeBricks, not legal advice. Have a licensed Indiana attorney review them before substantial commercial scale.

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “Subscriber”) and Applied Continuity LLC, an Indiana limited liability company doing business as KnowledgeBricks (“we”, “us”, “KnowledgeBricks”). They govern your access to our websites at knowledgebricks.com and estimating.knowledgebricks.com, the AI-assisted question feature (“Ask a SME”), the underlying content library, and any related services (collectively, the “Service”).

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Content License. If you do not agree, do not use the Service.

The Service provides browser-based access to a curated library of practitioner-grade content covering capital project estimating, equipment, integration, commissioning, and related operational topics (the “Content”), together with an AI-assisted question feature (“Ask a SME”) that retrieves and synthesizes answers from the Content. The Content is offered on a tiered subscription basis. Some pages are publicly readable; others require a paid plan.

You must be at least 18 years old and capable of forming a binding contract under applicable law. By using the Service you represent that you meet these requirements and that any information you provide is accurate and current.

  • Each subscription grants access to one (1) individual user. Accounts are personal and non-transferable.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • Account sharing is prohibited, including sharing with coworkers, contractors, family members, or any automated agent. We may detect and terminate accounts whose usage pattern is inconsistent with single-user access (for example, simultaneous logins from multiple regions).
  • Authentication is provided by a third-party identity processor. By creating an account you also accept that processor’s terms with respect to authentication processing.
  • Notify us promptly at support@knowledgebricks.com of any suspected unauthorized use.

5. Subscriptions, billing, and cancellation

Current plans, prices, and features are listed at /pricing. We may change pricing on at least thirty (30) days’ notice to existing Subscribers; changes apply at your next renewal.

  • Subscriptions auto-renew at the end of each billing period (monthly or annual) until cancelled.
  • Payments are processed by a third-party payment processor. Your payment instrument is stored and processed by that processor under its terms; we do not see or store full card numbers.
  • All prices are in US Dollars unless explicitly noted. You are responsible for any applicable taxes; we collect sales tax where legally required.
  • Promotional codes, coupons, and complimentary access (“Comp Access”) may be offered at our discretion and are non-transferable, have no cash value, and may be revoked at any time.

You may cancel at any time from the customer portal linked from your account page. Cancellation takes effect at the end of your current billing period; you retain access until that date.

  • 3-business-day refund window. If you cancel within three (3) business days of your first paid charge on a given subscription, email support@knowledgebricks.com and we will issue a full refund.
  • After 3 business days, fees are non-refundable except where refund is required by law.
  • We do not pro-rate refunds for partial periods, unused days, or downgraded tiers.
  • Annual plans are eligible for the same 3-business-day window from the initial charge of that annual term, including renewals.

If a payment fails, we may suspend access until it is resolved. After fourteen (14) days of unresolved non-payment your account may be terminated.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Content through the Service for your own professional development and operational reference.

This is a license to read, not to redistribute. See Section 8 below and the full Content License for the specific restrictions, including the prohibition on AI training.

All Content — including text, diagrams, structure, taxonomy, embeddings, and the compilation itself — is the exclusive property of KnowledgeBricks and is protected by US and international copyright, trademark, and trade secret law. “KnowledgeBricks”, “KBaaS”, and the related logos are trademarks of Applied Continuity LLC. These Terms do not transfer any ownership.

  • View and read Content within the Service for your own professional use.
  • Print or download individual articles for your personal reference.
  • Quote brief excerpts (under 200 words) in good-faith commentary or review with attribution to “KnowledgeBricks” and a link back to the Service.
  • Republish, mirror, repackage, or redistribute the Content, in whole or in substantial part, in any format, paid or free.
  • Share, resell, sublicense, or otherwise grant access to the Content or your account to any other person or organization.
  • Use the Content, the Ask a SME feature, or any output of the Service to train, fine-tune, evaluate, ground, retrieval-augment, or otherwise develop any machine-learning model, foundation model, embedding model, or AI system, whether for internal use or for distribution. This restriction applies regardless of whether the training is performed by you, on your behalf, or by an automated agent operated by you.
  • Use any automated means — including web crawlers, scrapers, headless browsers, or AI agents — to access, extract, copy, or index the Content beyond ordinary in-browser reading. Bypassing rate limits, paywalls, or tier gates is a material breach.
  • Reverse engineer, decompile, or attempt to derive the underlying source materials, embeddings, prompts, or system instructions of the Service.
  • Remove or alter any copyright, trademark, or attribution notice.
  • Use the Service in any way that violates the Acceptable Use Policy.

Breach of this Section 8 is a material breach that may result in immediate termination without refund, and entitles us to seek injunctive relief in addition to any other remedies.

Ask a SME generates answers using a large language model conditioned on excerpts from our Content. Answers are produced in real time and are provided as informational reference, not professional advice. Output may be inaccurate, incomplete, or out of date. Do not rely on Ask a SME output as a substitute for engineering judgment, legal advice, safety analysis, vendor specifications, or applicable codes and standards. You are solely responsible for verifying any output before using it operationally.

Your questions submitted to Ask a SME are logged and processed as described in our Privacy Policy, including automated redaction of personally identifying information before storage.

If you submit feedback, suggestions, error reports, or questions through Ask a SME, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use that input to operate, improve, and promote the Service, including to improve our Content and retrieval pipeline. We will not publicly attribute your input to you without your consent.

We aim to provide reliable access but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any portion of the Service at any time. We may add, remove, or revise Content as our editorial judgment requires; an active subscription does not guarantee continued availability of any specific page.

You may terminate your account at any time by cancelling and requesting deletion. We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you have breached these Terms, the Acceptable Use Policy, or applicable law, or to protect the Service or other users. On termination, your license under Section 6 ends immediately. Sections 7, 8, 10, 13, 14, 15, 16, and 17 survive termination.

THE SERVICE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY OUTPUT OF ASK A SME WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNOWLEDGEBRICKS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless KnowledgeBricks and its affiliates, officers, employees, and agents from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your breach of these Terms, the Acceptable Use Policy, or applicable law, or (c) your infringement of any third-party right.

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to personal jurisdiction and venue there. Each party waives any right to a jury trial.

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. For material changes, we will provide notice via the Service or by email to your account address at least fifteen (15) days before they take effect. Continued use after the effective date constitutes acceptance.

  • Entire agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the remainder remains in full force.
  • No waiver. Our failure to enforce any right is not a waiver.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices. Legal notices to us must be sent to support@knowledgebricks.com with “Legal Notice” in the subject line.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
